As you may be aware, there is a proposed new Copyright Directive in the EU, that has generated concerns.

It would be much appreciated, if in consultation with other partners in the WMF, chapters and project communities, if you were able to provide a position paper or statement on what changes the EU copyright directive may require (if any), and what changes the WMF plans to implement (if any). Works indicated as Public Domain in the US, but not necessarily having information about their status elsewhere

A related issue upon which clarification in the form of of guidance note, would be appreciated is:

  1. Whether projects (mostly English Wikipedia) should warn potential re-users to check the 'local' status of material, which may be Public domain in the US, but not elsewhere (due to differing terms)?
  2. If potential re-users should be warned, what language should in best practice be used in such warnings?
  3. Should the option (or requirement) to convert works with unclear global status to 'Non-free use' be permitted or recomended?
  4. What the applicability of the shorter US terms (and pre-1923 works) is in other major jurisdictions?
  5. Global applicability of US Gov inability to claim copyright in Federal works in the US?
  6. The appropriateness of considering a work to be PD US solely because it is pre 1923, even though it is NOT of US origin?
